Terms of Service

1. Account Registration

To use certain features of Today in History, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activity that occurs under your account

You must be at least 13 years old to create an account. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. License and Use

We grant you a personal, non-exclusive, non-transferable, revocable license to access and use Today in History in accordance with these Terms.

You may not:

• Copy, modify, or distribute the service or its content
• Reverse engineer, decompile, or disassemble any part of the service
• Use the service to build a competing product
• Access the service through automated means (bots, scrapers) without our written permission
• Resell, sublicense, or share your account access with others
• Use the service for any unlawful purpose

3. Subscriptions and Payment

Today in History offers a free tier and premium subscription plans. Current pricing is available at todayinhistory.app/pricing. We reserve the right to change prices with 30 days' notice. Price changes take effect at the start of your next billing cycle.

Subscriptions are billed monthly or annually. Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of that period.

We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us at support@downshift.dev within 30 days.

4. User Content

You retain ownership of any content you submit to Today in History. By submitting content, you grant us a limited license to store, process, and display that content as necessary to operate the service.

We do not claim ownership of your data. If you delete your account, we will delete your content within 30 days, except where required by law.

5. Acceptable Use

You agree not to:

• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Harass, abuse, or threaten other users
• Use the service to send spam or unsolicited communications
• Interfere with the proper functioning of the service

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Intellectual Property

Today in History, including its design, code, features, and content (excluding user content), is the property of Downshift LLC and is protected by intellectual property laws. Our trademarks, logos, and service names may not be used without our prior written consent.

7. Disclaimer of Warranties

Today in History is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure. We do not warrant the accuracy or completeness of any information provided through the service.

8. Limitation of Liability

To the maximum extent permitted by law, Downshift LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the service, any unauthorized access to or use of our servers, any interruption or cessation of the service, or any bugs, viruses, or other harmful code transmitted through the service.

Our total liability for any claim arising from these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Downshift LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the service or violation of these Terms.

10. Termination

We may suspend or terminate your access to Today in History at any time, with or without cause, with or without notice. Upon termination, your right to use the service ceases immediately.

You may terminate your account at any time by deleting it through your account settings or by contacting us at support@downshift.dev.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

12. Dispute Resolution

Any dispute arising from these Terms or your use of the service shall first be attempted to be resolved through informal negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in California.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting updated Terms on this page and updating the "Last updated" date. Your continued use of Today in History after changes are posted constitutes acceptance of the updated Terms.
